1. Preamble

1.1. Fashion Diffusion (hereinafter referred to as the “Operator”) operates the website and application fashiondiffusion.ai, a web-based platform for generating AI-powered fashion design images and related creative resources.

1.2. These Terms of Service apply to all users (hereinafter: the “User”) of the Fashion Diffusion platform.

1.3. By accessing or using the Platform, the User agrees to be bound by these Terms.

2. Rights of Use

2.1. The Operator reserves the right to restrict, suspend, or terminate access to the Platform at its sole discretion, with or without notice.

2.2. The User agrees that the Operator may collect and store IP addresses and usage data for security, abuse prevention, and system optimization.

2.3. All designs, images, videos, texts, or other content generated by the Platform are owned by the User. The User retains full rights and licenses to use generated outputs, subject to applicable laws.

3. User Rights and Obligations

3.1. The User agrees not to:

• Interfere with or disrupt the Platform’s functionality
• Attempt to access restricted systems or bypass security
• Introduce malware, bots, or harmful code
• Perform unauthorized scanning or testing of vulnerabilities

3.2. The User represents and warrants that they own or have obtained all necessary rights to any content uploaded to the Platform, including copyright, trademark, and other intellectual property rights.

4. Subscriptions and Payments

4.1. Some features of Fashion Diffusion may be provided through auto-renewable subscriptions.

4.2. Subscription Terms:

• Subscription duration may include weekly, monthly, or annual billing periods (as displayed at purchase)
• Payment will be charged to the User’s Apple ID account upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• The account will be charged for renewal within 24 hours prior to the end of the current period

4.3. Cancellation:

• Users may manage and cancel subscriptions at any time through their Apple ID account settings
• Cancellation will take effect at the end of the current billing cycle
• No cancellation of the current active period is permitted

4.4. Pricing:

• All pricing is displayed in the app and may vary by region
• Prices may change with prior notice

4.5. Refund Policy:

• Refund requests for subscriptions are handled by Apple in accordance with Apple Media Services Terms
• The Operator does not directly process refunds for Apple in-app purchases

5. Warranty and Liability

5.1. The Platform is provided “as is” without warranties of any kind regarding availability, accuracy, or performance.

5.2. The Operator is not responsible for data loss, service interruptions, or output accuracy except in cases of willful misconduct or gross negligence.

5.3. Liability is limited to USD $100, except in cases of injury to life, body, or health.

6. Privacy and Data Protection

6.1. The Operator may collect personal data such as name, email address, IP address, and usage information.

6.2. Data is used to provide and improve the service, ensure security, and comply with legal obligations.

6.3. Personal data may be stored and processed using AWS.

6.4. Data security measures include encryption (SSL/TLS) and AES-256 storage encryption.

7. Terms of Use (EULA)

7.1. These Terms constitute a legal agreement between the User and the Operator.

7.2. If the application is distributed via Apple App Store, Apple’s Standard Licensed Application End User License Agreement (EULA) applies in addition to these Terms: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

7.3. If there is any conflict between these Terms and Apple’s EULA, Apple’s EULA shall prevail for App Store users.

8. Governing Law and Jurisdiction

8.1. These Terms shall be governed exclusively by the laws of France.

8.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

9. Amendments

9.1. The Operator reserves the right to modify these Terms at any time.

9.2. Material changes will be communicated to users via the Platform.

10. Severability

10.1. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force.

11. Language

11.1. If these Terms are translated into other languages, the English version shall prevail in case of dispute.

12. Subscription Cancellation Clarification

12.1. Users acknowledge that subscriptions are managed entirely through Apple ID settings.

12.2. The Operator cannot cancel subscriptions on behalf of users.
